Temporary residence card is a document that allows foreign citizens to temporarily reside and work in Vietnam for a long time. With a temporary residence card, foreigners can enter and exit many times during the term of the temporary residence card without having to extend the Vietnam Visa.
1. Cases in which temporary residence cards are granted
Temporary residence card is issued by the immigration management agency or competent authority of the Ministry of Foreign Affairs to foreigners so that they are allowed to reside in Vietnam for a definite time and is valid in lieu of a visa. Cases to be considered for a temporary residence card include:
– Foreigners who are members of diplomatic missions, consular offices, representative offices of international organizations of the United Nations, intergovernmental organizations in Vietnam and their spouses and children under 18 years old, maid accompanied by term. Temporary residence card with symbol NG3;
– Foreigners enter Vietnam with visas with symbols: LV1, LV2, LS, DT1, DT2, DT3, NN1, NN2, DH, PV1, LD1, LD2, TT. Temporary residence card has the same symbol as a visa.
2. Conditions for granting temporary residence card
– Passport valid for at least 1 year.
– Visa used when entering Vietnam must be for the right purpose.
– Documents proving that they are eligible for temporary residence cards of foreigners with a validity of at least 01 year or more (eg work permit,…).
3. Dossier to apply for a temporary residence card
– The written request of the agency, organization or individual that carries out the procedures for invitation and guarantee, specifically:
+ For agencies and organizations: Form NA6 (Issued together with Circular 04/2015/TT-BCA).
+ For individuals: Form NA7 (Issued together with Circular 04/2015/TT-BCA).
– Application form for temporary residence card with photo: Form NA8 (Issued together with Circular 04/2015/TT-BCA);
– Passport;
– Proof of eligibility for temporary residence card.
3.1. Dossier for foreign workers who have been granted work permits:
– Copy of Business Registration Certificate or other equivalent documents;
– Copy of seal sample registration certificate;
– Copy of Tax Registration Certificate;
– A copy of the work permit with a term of 1 year or more;
– 04 photos 3×4 cm, bare head, front view, clear face, clear ears, no colored glasses, photos taken not older than 6 months;
– 01 photocopy of passport, valid visa, entry and exit slip (enclose the original for comparison);
– A copy of the certificate of temporary residence certified by the ward police.
3.2. Dossier for foreign workers who are not subject to work permits:
– Copy of Investment Certificate or other equivalent papers;
– Copy of seal sample registration certificate;
– Copy of Tax Registration Certificate;
– Copy of documents proving that you are not eligible for a work permit;
– 04 photos 3×4 cm, bare head, front view, clear face, clear ears, no colored glasses, photos taken not older than 6 months;
– 01 photocopy of passport, valid visa, entry and exit slip (enclose the original for comparison);
– A copy of the certificate of temporary residence certified by the ward police.
3.3. Documents for relatives accompanying the foreign worker: in addition to the documents of the foreign worker, the accompanying relative needs to provide the following documents:
– 04 photos 3×4 cm, bare head, front view, clear face, clear ears, no colored glasses, photos taken not older than 6 months;
– 01 photocopy of passport, valid visa, entry and exit slip (enclose the original for comparison);
– A copy of the certificate of temporary residence certified by the ward police;
– A copy of the document proving the purpose of applying for a temporary residence permit: depending on the specific case, a notarized copy of the marriage registration certificate must be provided; Birth certificate; Documents proving family relationship,…
4. Term of temporary residence card
– DT1: no more than 10 years;
– NG3, LV1, LV2, LS, DT2 and DH: no more than 05 years
– NN1, NN2, DT3, TT: no more than 03 years
– LD1, LD2 and PV1: no more than 02 years
Note:
– The duration of the temporary residence card issued is at least 30 days shorter than the remaining validity of the passport.
– Expired temporary residence card will be considered for a new card.
